You can always fire your laweyr and most likely he can charge you for expenses he has incurred, which would be minor, since most likely after 1 week, no settlement has been offered.  (IF), you have uninsured bodily injury on your policy, then since the other guy has no insurance, then they will pay for your injuries in a settlement.  It is just like if the other guy has insurance, they pay for your injury settlement due to this accident.  So if you keep the laweyr and (IF) you have uninsured bodily injury, then he would be entitled to 1/3 of YOUR settlement.  But,,,,,,if your policy pays, then your insurance company will go after this guy personally .since they will have a vested interest, since once they pay, they want their money back also.   Now, (IF), you don't have uninsured bodily injury, then my guess your laweyr may not want to pursue this other guy, since if he has no assets, then he gets nothing and neither do you. Anyone can sue and win, but the problem is can you collect, since the courts don't collect for you, they can only issue a judgment.
